Terms of business

1. In these terms of business the following terms have the meanings set out opposite them:-

"the Agency" - Select Au-Pairs, Crosbie House, Moredun Road, Paisley.

"Au-Pair" - A young person aged between 17 and 27 who fulfils the conditions laid down in the Home office Immigration and Nationality Department Rules regarding the admission of au-pairs to the United Kingdom. The Agency will normally introduce only female au-pairs.

"the Client" - The person or persons. making application to the Agency for the introduction of an au-pair and/or to whom the au-pair is introduced.

2. The Agency will only consider applications submitted on the Agency's own application form as supplied to the client. The Agency reserves the right to require supplementary information from the client before registering the client's interest with the Agency.

3. Where a client's interest has been registered with the Agency, the Agency will as soon as practical thereafter supply the client with details of potential au-pairs. Wherever possible the Agency will try to supply details of at least three potential au-pairs but cannot warrant that this will be possible in every case. A registration fee of £50 is applied with registration to cover administrative expenses.

The Agency proceeds in all cases on the basis of the information contained in the application form. It is the client's responsibility to ensure that the information in the application form is full and correct.

4. When the client has decided on an au-pair that they wish to invite to the United Kingdom, the client must first contact the Agency to obtain confirmation that the au-pair is available and authorization to approach the au-pair.

Once authorization has been given by the Agency to approach the au-pair, the client will be solely responsible for writing to the au-pair inviting the au-pair to the client's home and except as provided in these terms of business for agreeing with the au-pair the terms and conditions for her stay in the United Kingdom with the client. The Agency has advised all potential au-pairs that the minimum "pocket money" paid by a client to an au-pair will be at least £60.00 per week. All clients are deemed to have undertaken to pay at this rate.

5. Unless the client advises the Agency to the contrary within fourteen days of receiving authorization to approach the au-pair, the Agency will assume that the client has engaged the au-pair and will invoice the client accordingly. Where the client requests an au-pair placement for a period of more than three months, the Agency's fee will be £350.00. Where the client requests an au-pair placement for a period of up to three months, the Agency's fee will be £175.00. In each case these fees are exclusive of any VAT which may be chargeable thereon.

All fees are payable within seven days of the date of invoice.

Details of potential au-pairs are provided for the use only of the client and if that client passes these details to a third party who subsequently engages one of the au-pairs, the client remains liable to the Agency for the fee due to the Agency in terms of this condition as if the client had engaged the au-pair.

6. (a) If the au-pair leaves the client's home within twenty one days of the commencement of the placement, the Agency will use its best endeavours to offer the client a replacement au-pair. If the Agency is unable to offer a replacement au-pair, it will, subject to the terms of sub-clause (b), refund one half of the fee paid by the client to the Agency. The Agency will not refund any part of the fee paid where a replacement au-pair is not accepted by the client;

(b) No refund of any fee paid will be made should the au-pair leave the client's home after (i) fourteen days from the commencement of the placement where the placement is for a period of up to three months and (ii) twenty one days from the commencement of the placement in all other cases;

(c)Where the au-pair accepts a client's invitation to travel to the United Kingdom and fails to arrive, the provisions of sub-clause (a) will apply with regard to the Agency offering a replacement and the possible repayment of any fee paid;

and

(d) No repayment of fee will be made where the client issues an invitation to an au-pair whish is accepted and thereafter cancels that invitation prior to the au-pair travelling to the United Kingdom.

7. The Agency assesses all potential au-pairs on the basis of information provided either by the au-pairs or by reputable agencies in their home countries. The Agency has no way of

checking the accuracy and reliability of information provided by applicants and the Agency gives no warranty as to the suitability of applicants or their ability or willing

-ness to fulfil their responsibilities in terms of any agreement which the au-pair may reach with the client.

In no circumstances will the Agency be liable for any action of the au-pair while the au-pair is resident with a client in the United Kingdom. Any client unsure about the effect of engaging an au-pair on any insurance cover which the client may have, should contact their insurance adviser prior to engaging the au-pair.
